It is technically illegal, but so are numerous other "modded" controllers. Nobody has everclaimed to or been proven to be banned for XIM. It is IMPOSSIBLE for them to tell whether or not you are using one, don't let anybody tell you otherwise. The only way anybody could know for certain is if you record yourself using it.
I'd go to the XIM forums for this discussion if you want reassurance that nobody gets banned for using it.
